Put probe officer back on job,court tells govt
A division bench of acting Chief Justice Bhaskar Bhattacharya and Justice J B Pardiwala passed an order while acting on an application that had challenged the change of Investigating Officer.
The application was moved by advocate Girish Das,who has also moved a public interest litigation in favour of the children who were tested HIV positive. He had alleged the transfer was done with malafide intention to make sure that the investigation was remote controlled.
Following the application,the court had summoned Bhutada to remain present before it today. The court asked Bhutada if she had any problem in completing the investigation,to which she replied she did not have any problem in doing so.
The court also had a few words of suggestion for Bhutada,a young IPS officer. The court said a police officer should be like a lion and she should take up the challenge of handling the case.
According to Das,the government had for some time tried to resist the restoration of the IO saying Bhutada is posted in Amreli and suggesting that it would be practically very difficult for her to complete the investigation.

Das said,Not accepting the arguments of the government,the court has ordered it to issue a notification by tomorrow (Friday) to re-appoint Bhutada as the IO. The court also ordered that Bhutada will be deputed to Amreli district for the task and till then,a Deputy Superintendent of Police rank officer will hold charge of Amreli District Superintendent of Police.
According to Das,the court has sought to know a few points from the IO related to the case. And Bhutada has been directed to investigate a couple of points from them and report the same to the court by June 10 when further hearing is scheduled.
In February this year,the High Courrt had ordered the government to register an FIR in the case against those responsible on the basis of complaint lodged by the parents of the victim children.
The court had also ordered to get the investigation supervised by a DIG rank officer.
